Terms of Service

1. Who we are and what these Terms cover

The race-preparation service available at https://hyrox.peakiq.ai (the "Service") is operated by Sparta Enterprise LTD (the "Operator", "we"), the company behind the PeakIQ product family. The Service is currently offered under the working name "Race Prep by PeakIQ"; the product name may change, and a name change does not affect these Terms or your purchase.

These Terms govern your use of the Service, including the free finish-time predictor, the paid race-preparation block, the athlete application, and the Garmin connection. By using the Service or purchasing access, you agree to these Terms.

2. Independence — HYROX and Garmin

HYROX® is a registered trademark of its owner. This Service is an independent product and is not affiliated with, endorsed by, or sponsored by HYROX or any race organizer. References to HYROX races, formats, stations, or events are factual references so the Service can prepare you for events you have entered. Garmin® and device names such as Forerunner®, fēnix® and Epix® are trademarks of Garmin Ltd. or its subsidiaries. We are an independent developer using Garmin's official developer APIs; Garmin does not endorse or sponsor the Service.

3. Eligibility

You must be at least 18 years old and able to enter a binding contract to use the Service. The Service is not directed at children, and we do not knowingly allow accounts for anyone under 18.

4. What the paid product is

The paid product is a one-time digital purchase: an adaptive race-preparation block for one race entered by you, comprising: a predicted finish-time range with per-segment splits; a deterministic multi-week training plan built to your race date, availability and equipment; delivery of structured workouts to your compatible Garmin watch; processing of your completed activities; weekly plan adaptation; race-week preparation; and a post-race review. One purchase covers one race block. It is not a subscription and does not auto-renew.

"Founding" pricing (currently USD 49, regular USD 69) is a launch price for early customers and may change for future purchasers; a later price change does not affect a completed purchase.

5. Device requirement

The core of the Service delivers structured workouts to a Garmin watch that supports structured workouts and requires you to connect your Garmin account. Without a compatible, connected Garmin device the central feature of the Service does not work — that is why we verify your watch with a test workout before your plan starts, and why an unsupported device is grounds for a full refund (see the Refund Policy). Apple Watch and other devices are not supported at this time.

6. Your account

Access to the paid product requires an account (email sign-in link or password). You are responsible for keeping your sign-in method and claim links secure and for activity under your account. One purchase can be claimed by one account. Tell us promptly at the support address below if you believe your account is compromised.

7. Training and health — read this section carefully

Physical training carries real risk, including injury, aggravation of existing conditions and, rarely, serious cardiac events. HYROX-style training is demanding: it includes high-intensity running, sled work, and loaded movements.

By using the Service you confirm that: (a) you are voluntarily choosing to train; (b) you are responsible for judging whether you are fit enough to perform any session; (c) you will obtain medical clearance before starting if you have any medical condition, are pregnant, are returning from injury, or have been advised to limit exercise; and (d) you will stop training and seek medical help if you experience chest pain, severe shortness of breath, dizziness, fainting, or any symptom that concerns you. In an emergency, contact local emergency services. The Service has no emergency capability.

The Service is not medical care. It does not diagnose, treat, cure, rehabilitate, or prevent any disease or injury, and it is not a substitute for a physician, physiotherapist, or qualified in-person coach. The "pain/niggle" feature exists only to make the training plan more conservative; it is not an assessment of injury. If pain changes how you move or persists, see a qualified professional — the plan will wait.

9. Third-party services, Garmin dependence, and outages

The Service depends on third parties: Garmin (device sync, workout delivery, activity data), FastSpring (payments), Supabase (data platform and sign-in), Vercel (hosting), and Postmark (email). We do not control these services. Garmin APIs, device firmware, and supported features can change, degrade, or fail; a workout can fail to reach a watch; an activity can fail to sync. We build for these failures (retry, re-send, manual logging, held queues) and will make reasonable efforts to restore functionality, but we are not liable for third-party outages or changes. If a Garmin-side change permanently removes the Service's core capability, Section 15 (refunds and remedies) applies rather than any larger claim.

10. Payments — FastSpring as Merchant of Record

Purchases are processed by FastSpring (Bright Market, LLC d/b/a FastSpring), our reseller and Merchant of Record. When you buy, your contract of sale — including payment processing, invoicing, and applicable taxes/VAT — is with FastSpring under FastSpring's Terms of Sale. FastSpring collects and remits sales taxes and VAT where applicable; displayed prices may be exclusive of taxes depending on your location. We (Sparta Enterprise LTD) provide the Service itself and your entitlement to it. Refunds are governed by our Refund and Cancellation Policy and executed by FastSpring.

11. Acceptable use

You agree not to: share, resell, or transfer your access; reverse-engineer, scrape, or bulk-extract the Service or its models; probe, overload, or attempt to bypass security or entitlement checks; submit false data intended to manipulate the Service; use the Service to build a competing dataset; infringe others' rights; or use the Service where prohibited by law. We may rate-limit, suspend, or terminate access for violations (Section 14).

12. Intellectual property; your data; feedback

The Service — including its software, prediction and planning rule-sets, designs, and content — is owned by the Operator or its licensors. Your purchase grants you a personal, non-transferable licence to use the Service for your own training. Your data remains yours: you grant us the licence needed to operate the Service for you (process your inputs and training data to deliver the features described here, as detailed in the Privacy Policy). Race Cards generated for you are yours to share. If you send us feedback or suggestions, you grant us a perpetual, royalty-free licence to use them without obligation.

13. Service changes

We improve the Service continuously and may change features, rules versions, and interfaces. We will not materially remove the core paid capability of an active race block (plan delivery to your watch and adaptation through your race) except where Section 9 (third-party dependence) forces it — in which case the Refund Policy applies. Plan and prediction rule-sets are versioned; changes apply prospectively.

14. Suspension, termination, deletion

We may suspend or terminate access for material breach of these Terms, fraud or chargeback abuse, or unlawful use — where practicable, with notice and a chance to respond. You may stop using the Service at any time and may delete your account and data from Settings; deletion is permanent and immediate (order and entitlement records are retained as financial records, without your training data). Refund consequences of termination and deletion are set out in the Refund Policy.

15. Disclaimers and limitation of liability

Except as expressly stated in these Terms, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-interruption. To the maximum extent permitted by law: (a) we are not liable for indirect, incidental, special, or consequential losses, or loss of data, profits, or race outcomes; and (b) our total aggregate liability arising out of the Service is limited to the amount you paid for the affected purchase.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law — including liability for death or personal injury caused by negligence, for fraud, or your non-waivable statutory consumer rights in your country of residence (for example under EU, UK, or Israeli consumer law). If any part of this section is unenforceable where you live, it applies to the greatest extent permitted.

16. Governing law and disputes

These Terms are governed by the laws of the State of Israel, and disputes are subject to the competent courts of Tel Aviv-Yafo — except that if you are a consumer in the EU, UK, or another jurisdiction with mandatory consumer protections, you keep the protection of the mandatory rules, and where required the courts, of your country of habitual residence. Before any formal step, contact us at the support address below — we resolve almost everything directly, usually the same day.

17. Changes to these Terms

We may update these Terms. Material changes will be notified by email or in-product notice with the new effective date; continued use after the effective date is acceptance. The version and date at the top identify the current Terms. Changes do not reduce refund rights attached to an existing purchase.
